Falling trees can cause catastrophic injuries

Trees are a great addition to just about any property. They add beauty, shade and character to the area, but it’s critical that the trees are cared for properly, so they don’t become a hazard to people on the property.

Some landlords, particularly those who aren’t actively involved in the management of the property, may be warned that there are signs that the trees are in trouble. However, they may not take the situation seriously.

Catastrophic and fatal injuries are possible

Often trees can become unstable and fall, and generally there are warning signs. When ignored, damaged or dying trees can lead to catastrophic crushing or penetrating injuries to people who are near the tree when it falls.

In some cases, improperly maintained trees can lead to fatal injuries, even if the entire tree doesn’t fall. In one case, a falling tree limb fell on a woman while she was watching a softball game. That woman died from her injuries.

Known risks must be addressed

A tree is in distress is usually easy to spot and sends signals that it is dangerous.  However, just how dangerous is often not perceptible. It Because of this, any landlord or property owner who gets reports that something is amiss should have the tree evaluated by an expert. In fact, it’s good practice to have an expert inspect the trees on a regular basis so any problems can be proactively addressed before they cause injuries to innocent people.

Legal consequences

Landlords:
If a landlord or property owner fails to heed warning signs, they can be held liable for injuries or deaths suffered from a falling tree. Oftentimes, these incidents are entirely preventable through regular maintenance. If you’re a landlord, don’t dismiss reports from tenants of sick or damaged trees. If you have a property that’s managed by a 3rd party, insist that they regularly check on trees to ensure that there are not any safety hazards. The lives of your tenants may count on it, and it could save you from costly fines and even prison time.

Victims:
Those injured by falling trees or branches that are the result of a property owner’s negligence may opt to pursue a compensation claim. There are time limits that apply to these cases, so it may be beneficial to work with someone who’s familiar with these matters so they can get the case moving forward.
